TERMS & CONDITIONS

1. THE AIRWAY BILL

The Tradelink International Waybill is a non-negotiable document, which may be prepared by either the shipper or Tradelink International on behalf of the shipper. Tradelink International's responsibility for a shipment, when accepted under a Waybill, ceases upon the consignee's receipt acknowledgment, indicated by their signature on the return original copy or the delivery sheet. It is important to note that all shipments under the Waybill are carried at the owner's risk.

2. SHIPPER OBLIGATION AND ACKNOWLEDGMENT

When materials are tendered for shipment through Tradelink International, it is assumed that the shipper agrees to the terms and conditions outlined herein. The shipper represents that they are either the owner of the goods being transported or are an authorized agent, and they accept these terms and conditions on their own behalf and on behalf of any other parties with an interest in the shipment.

The shipper further guarantees that each item in the shipment is accurately described on this Waybill and complies with the provisions of the Indian Post Office Act and other relevant laws. They also affirm that the shipment is adequately marked, addressed, and packed to withstand safe handling.

The shipper is solely liable for all costs and expenses related to the shipment, including octroi, state and local taxes, and imports. This responsibility extends to costs incurred in returning the shipment to the shipper or warehousing the shipment until return.

The shipper accepts that Tradelink International is responsible for the shipment only from the point of origin to the address specified on the Waybill. In case of rerouting or redirection, the shipper is responsible for all associated charges levied by Tradelink International. Tradelink International reserves the right to hold the shipment at the destination address for a maximum of 10 days from the shipment date. After this period, Tradelink International may, without notice, opt to destroy the shipment, and the shipper indemnifies Tradelink International against any claims or liabilities arising from this action.

The shipper is responsible for properly packing the materials submitted for shipment, including their placement inside containers provided by Tradelink International.

3. TRADE LINK RIGHTS OF INSPECTION OF SHIPMENT

Tradelink International reserves the right (but not the obligation) to open and inspect shipments. Tradelink International also holds the discretion to refuse shipments that do not conform to the specified terms and conditions without providing a justification.

4. INSURANCE

The shipper has the option to insure their shipments at their own expense.

5. OCTROI

Any applicable sales tax or duties on the shipment are the responsibility of the consignee upon delivery. Tradelink International retains the right to withhold any shipment until all associated charges have been paid in full.

6. CHARGEABLE WEIGHT

Shipments are assessed based on their chargeable weight, which is determined as the higher of the actual weight (rounded up to the next half kilogram or one kilogram, as per the agreed rate category) or the volumetric weight (similarly rounded as above). Volumetric weight is calculated as the gross cubic volume in cubic centimeters divided by 5000.

7. LIEN ON GOODS SHIPPED

Tradelink International holds a lien on shipped goods for all freight charges, octroi, state and local taxes, advances, or other charges arising from transportation. Tradelink International may refuse to release possession of goods until these charges are paid.

8. LIMITATION OF LIABILITY

Tradelink International's liability for any loss or damage to a shipment, including documents or parcels, is capped at the lowest of (a) Rs. 500, (b) the actual loss or damage amount to the document or parcel, or (c) the value of the document or parcel as determined without considering its commercial utility to the shipper. Under no circumstances shall the actual value of the document or parcel exceed Rs. 500.

9. CONSEQUENTIAL DAMAGES EXCLUDED

Tradelink International shall not be held liable for any consequential or special damages, whether direct or indirect, arising from transportation, regardless of whether Tradelink International was informed of the possibility of such damages. This includes but is not limited to losses such as income, profits, interest, utility, or markets.

10. LIABILITIES NOT ASSUMED

Tradelink International will not be liable for any loss, damage, or delay in picking up or delivering shipments due to reasons including but not limited to Acts of God, force majeure, actions of the shipper, consignee, or other parties with an interest in the shipment, carrier deviations from schedules, government actions (such as Customs/Taxation/Octroi inspections), the nature or characteristics of the shipment, electrical or magnetic interference, or damage to photographic images or recordings in any form. The shipper indemnifies Tradelink International against losses, damages, penalties, and actions initiated by government officials in the discharge of their official duties.

Regardless of the circumstances, Tradelink International will endeavor to provide expeditious delivery in accordance with its regular delivery schedule; however, Tradelink International will not be liable for any delays in pickup, transportation, or delivery of any shipment.

11. RETURN FREIGHT & DUES FOR RTO SHIPMENT

The shipper is entirely responsible for charges related to clearance, import duty, taxes, warehouse fees, and other dues at the destination if the consignee refuses to pay. Shipments not delivered at the destination for any reason may be automatically returned to the origin or destroyed without prior notice. Return freight and destroy charges will be payable by the shipper according to the carrier company's tariff, along with all dues.

12. CLAIMS

Any claims must be submitted in writing by the shipper to the nearest Tradelink International office within 15 days of shipment acceptance. Tradelink International will not entertain any claims beyond this time limit. Additionally, no claims for loss or damage will be considered until all charges have been paid. These claims will not be deducted from any transportation charges owed to Tradelink International.

13. MATERIAL NOT ACCEPTED FOR CARRIAGE

Tradelink International does not accept materials that are not permitted by prevailing laws, rules, or restrictions, including prohibited items such as share certificates and blank signed share transfer forms. Tradelink International accepts shipments based on the shipper's declaration of the shipment's type and value ("said to contain" basis). The shipper indemnifies Tradelink International and holds it harmless from any claims arising from the shipper's declaration.

NOTE: ALL DISPUTES AND CLAIMS ARE SUBJECT TO MUMBAI JURISDICTION.

Notes for Rates & Charges:

  1. Variable fuel surcharge and service tax are extra as applicable.
  2. All mail services are collected from your office and delivered to the consignee's doorstep at no additional charge.
  3. Chargeable weight is rounded to the next higher 500 grams or 1 kilogram as per the rate slab. Chargeable weight includes actual weight or volumetric weight, whichever is higher when considering packaging.
  4. Deductions on courier charges for late delivery, customs delay, or damages will be allowed only when approved by our principal.
  5. Custom clearance, handling/packing, DG clearance, DG fee, loading/unloading, and transportation charges are extra as applicable. Additional charges apply for the clearance of chemical, liquid, and electronic shipments.
  6. Rates and surcharges are subject to change without prior notice. Please confirm new rates or special offers before booking.
  7. Address correction, remote area charges, and return freight with all dues will be charged to the shipper.
  8. Lost compensation is capped at the declared invoice value or Rs. 500, whichever is lower.
  9. Tradelink International does not accept items that infringe the Indian Postal Act and all restricted items as per IATA guidelines.
